Bouchey Law | LLC (collectively, the firm) is committed to protecting the privacy of confidential and “Personal Information” (information that directly or indirectly identifies individuals who may be account holders, clients, staff, agents, website visitors, or lawyers). It is the policy of the firm to comply with the rules of professional conduct, which impose a duty to preserve and protect confidential client information, upon lawyers and their associated personnel. This Privacy Policy and Cookie Policy (the “Privacy Policy”) is based on the privacy and data protection principles in the United States. We comply with law with our obligations to the law, to preserve client confidentiality and to represent our clients as effectively as possible within the boundaries of the law. This Privacy Policy describes the data protection policies of the firm, and informs our clients, website visitors, and other third-parties about the firm’s privacy policy.
This Privacy Policy is also addressed to parties outside the firm who provide Personal Information to the firm or who visit or use the firm’s website, create an account to use the online filing services, as well as to send email messages that contain a link to this Privacy Policy (collectively, the “Services”). This Privacy Policy also describes how the firm collects, processes and discloses Personal Information in connection with the provision of Services and Site.
Personal Data We Collect
The firm collects Personal Information in the course of providing Services to clients and as provided by visitors to its website or users of Services. We may also collect Personal Information about you when you interact with us on social media sites and from other third parties and may also automatically collect information that may contain Personal Information as described below in the cookie policy. For those ordering online filing services, we may collect name, email address, telephone number, mailing address, and IP address at the time of the transaction.
We may use that Personal Information where in our legitimate interest to do so for the following purposes:
- to contact you and respond to your requests and inquiries,
- to personalize your visit and use of the Services and to assist you while you use those services,
- to carry out, monitor and analyze our business or website operations,
- to provide clients with an attorney-client relationship with legal services, IF you are or become a client of the firm, and otherwise deal with you, and administer the matters you instruct us on,
- to process information for filing of documents at the USPTO, US Copyright Office, or state Secretary of State offices,

Where Personal Information is necessary for the firm to carry out its anti-money laundering checks failure to provide such information may result in the firm not being able to provide the representation.
Cookies
If you visit the Site and/or use the Services, you may opt-in to saving your name, email address and website in cookies to complete online filing services. These are for your convenience so that you do not have to fill in your details again when you leave and return. These cookies will last for one year. If you have an account and you log in to this Site, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.
When you log in and access the online document filing services or your account, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.
Embedded Content From Other Websites
Certain online services offered on the Site may include embedded content (e.g. plugins, payment vendors, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website. Embedded Content may include payment services such as ClioPay and Plaid, communication services such as Microsoft Teams, SMS messages, Social login services from Apple and Google, and analytics services from Google Analytics. For paid phone call and video/web chat and services, we rely on RingCentral and Clio for note taking purposes.
These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website. What may constitute confidential information provided to Attorneys is maintained in an encrypted, siloed, confidential form and is not available to third-parties.
Confidentiality, Security, and Retention of Personal Information
It has always been the policy of the firm to exercise confidentiality regarding the information our clients entrust to us. The Firm maintains and practices reasonable and appropriate, albeit not infallible, physical, electronic and procedural safeguards intended to maintain the confidentiality of Personal Information, including that provided by visitors to this Site and provided while using other Services. Firm cannot guarantee that the safeguards implemented are infallible. Firm requires that consultants, suppliers and vendors also maintain data protections consistent with reasonable and appropriate obligations of data processors, including, where applicable, European Union’s data protection laws and regulations. Firm may retain information provided by you, including Personal Information, for as long as necessary to comply with our legal obligations, or to achieve the purposes for which the information was originally collected and for the purposes described in the Statement and in our applicable policies. Who We Share Your Data With
- We use Google Analytics. You can disable sharing of Google Analytics on your google account settings.
- Payment processing is performed through ClioPay and Plaid.
- We also use Clio to schedule calendar appointments.
How Long We Retain Your Personal Data
If you contact us via email, the email and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up email responses and maintain our client contact records for possible conflict of interest checks.
For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.
What Rights You Have Over Your Data
If you have an account on this site, you can request to receive a copy of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes. If you opt-in to receive SMS text messages regarding your case , upcoming appointments, court dates/deadlines, etc., please rest assured that Bouchey Law | LLC does not share or sell any opt-in/user data, or phone numbers with any third parties. You may opt out of receiving SMS text messages from Bouchey Law | LLC at any time, by replying to one of the messages with the word "STOP".
Where We Send Your Data
Our cloud based infrastructure and associated servers are located in the United States. We do not sell your personal information to any third-parties.
Changes To This Privacy Policy
We reserve the right to change this Statement and Privacy Policy at any time without advance notice. Should any new policy go into effect for our Internet Services or changes to Embedded Content, the firm will post it on this website at this Internet address.
